- Description: Bills of Costs are the expenses arising from an Appeal Case. They contain detailed accounts of all of Respondent's costs and the date the bill of cost was served. If the losing party feels the costs demanded by lawyer are unreasonable they can ask the Clerk of the Judicial Office to make an assessment of reasonable costs. This procedure is known as Taxation. A hearing will be held in the presence of the Clerk of the Judicial Office, a Law Lord and the Taxation clerk who determine the costs in what is often a complicated procedure. Bills of Costs are held from both Her Majesty's Court of Appeal and from Her Majesty's Court of Criminal Appeal.
The accompanying papers are;
Taxation Certificates - the formal certificates issued when the Taxation Clerk has concluded the bill. Draft copies are also included in the Bills of Cost.
Analysis of Bills of Costs - reference files which were used by the Taxation Clerk for quick reference instead of referring to the lengthier Bills.
Taxing fee notebooks - list of possible fees the office could apply.
Taxation Summaries - created by the office to summarise Bills of Costs. Each case's full title and Bills of Cost reference is listed. The typed summaries note the following; Civil or Criminal Petition for Leave to Appeal, Legal Aid Certificate, Petition for Leave, Counsel's Fees, Attending Petition, Attending Counsel (Petition), Attending Appeal Committee, Instructions, Attending Taxation, Notes and Certificate Issued. The final amount agreed by the office is handwritten underneath each section, sometimes in red. Each volume includes an index. - Accruals: The Judicial Office ceased to function in 2009 when judicial activities moved to the UK Supreme Court. No further accurals are expected.
- System of Arrangement: HL/PO/JU/5/1 - HL/PO/JU/5/125 are arranged chronologically to allow cross-referencing with Appeal Cases (series HL/PO/JU/4/3). HL/PO/JU/5/126-164 are arranged based on office's arrangement when records were transferred in 2009.
